These Terms & Conditions ("Terms") govern your access to and use of the GLP-1 Muscle & Hair Preservation Protocol, including all digital guides, workbooks, trackers, and related materials (the "Service"), provided by Paige McCalmon, DNP, FNP-C ("Seller," "we," "us," or "our"). By accessing, purchasing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

1. Contracting Party

You are contracting with Paige McCalmon, DNP, FNP-C, the seller and provider of the Service. These Terms form a legally binding agreement between you and the Seller.

2. Acceptance of Terms

By purchasing, downloading, accessing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. Your continued use of the Service constitutes your ongoing acceptance of these Terms and any updates we may make.

3. Authority & Eligibility

You represent that you are at least 18 years of age (or the age of legal majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are accessing the Service on behalf of an organization, you represent that you have the authority to bind that organization.

4. Description of the Service

The Service is a collection of digital educational materials—including the GLP-1 Glow Guide Digital Workbook, the GLP-1 Daily Nutrient Tracker, the Skin-Back Elasticity Guide, the Maintenance Phase Roadmap, and the 7-Day GLP-1 Meal & Movement Jumpstart—designed to support individuals using GLP-1 receptor agonist medications in preserving muscle mass, hair health, and skin elasticity during weight loss.

5. Payment, Billing & Subscription Terms

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, which are incorporated herein by reference.

6. Licence to Use the Service

Subject to your compliance with these Terms, the Seller grants you a limited, non-exclusive, non-transferable, revocable licence to access and download the digital materials for your personal, non-commercial use. You may not reproduce, distribute, publicly display, publicly perform, sell, rent, lease, lend, sublicense, or otherwise transfer the Service or any part of it to any third party.

7. Intellectual Property Rights

The Service and all of its contents—including text, graphics, guides, workbooks, trackers, branding, and downloadable files—are the intellectual property of Paige McCalmon, DNP, FNP-C. The Seller retains all right, title, and interest in and to the Service, including all copyrights, trademarks, and other proprietary rights. Nothing in these Terms grants you any right, title, or interest in the Service except for the limited licence expressly set forth above.

8. Account Credentials & Accuracy

If you create an account or receive access credentials, you are responsible for maintaining the confidentiality of those credentials and for all activity that occurs under them. You agree to provide accurate and complete information when purchasing the Service and to keep that information current.

9. Acceptable Use & Misuse

You agree not to misuse the Service. Prohibited conduct includes, without limitation:

• Using the Service for any unlawful purpose or in violation of any applicable law.
• Engaging in fraud, spam, or any deceptive practice, including submitting fraudulent payment information.
• Infringing upon the intellectual property rights, privacy, or other rights of any person.
• Interfering with or disrupting the security of the Service, including introducing malware, probing, scraping, or attempting to gain unauthorized access to systems or data.
• Reverse engineering, decompiling, or disassembling any part of the Service.
• Reselling, redistributing, or commercially exploiting the Service without permission.
• Circumventing any technical limitations or access controls on the Service.

10. No Medical Advice

The Service is provided for general educational and informational purposes only. It is not intended to be, and should not be construed as, medical advice, diagnosis, or treatment. The Service is not a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider. Always consult with your physician or other qualified health provider before beginning any nutrition, exercise, or supplementation program, especially if you are taking prescription medications such as GLP-1 receptor agonists.

11. Service Level

The Service is provided on an "as available" basis. The Seller does not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times. We may modify, suspend, or discontinue any part of the Service at any time without notice.

12. Disclaimers & Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, the Seller disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. The Seller does not warrant that the Service will meet your requirements, that the results obtained from the Service will be accurate or reliable, or that the Service will be free of errors or viruses.

13. Limitation of Liability

To the fullest extent permitted by law, in no event shall the Seller be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your access to or use of (or inability to access or use) the Service. The Seller's aggregate liability for all claims arising out of or relating to the Service shall not exceed the amount you paid to the Seller for the Service in the six (6) months preceding the claim. This limitation does not apply to liability that cannot be limited under applicable law, such as liability for fraud, death, or personal injury caused by negligence.

14. Indemnification

You agree to indemnify and hold harmless the Seller and her affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.

15. Suspension & Termination

The Seller may suspend or terminate your access to the Service at any time, without notice, if you materially breach these Terms, fail to pay any amounts due, pose a security or fraud risk, or engage in repeated or serious violations of these Terms. Upon termination, your licence to use the Service ends immediately. You may also terminate your use of the Service at any time by ceasing to access it. Upon termination, access to downloaded materials may be revoked where permitted by law.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.

17. Assignment

You may not assign or transfer these Terms or your rights under them without the prior written consent of the Seller. The Seller may assign these Terms freely in connection with a merger, acquisition, reorganization, or sale of all or substantially all of her assets. Any attempted assignment in violation of this section is void.

18. Force Majeure

The Seller shall not be liable for any failure or delay in performance caused by events beyond her reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, labor disputes, internet or telecommunications failures, or governmental actions.

19. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
